Connecticut, Tennessee, Louisiana, and Kansas have already enacted total prohibitions, with local jurisdictions like Los Angeles County and Nassau County, New York, adopting similar restrictive measures to curb availability.

The industry remains fractured over how to address these rising safety concerns. Companies specializing in plain-leaf products, such as the Idaho-based Happy Hippo, maintain that their natural offerings are distinct from high-potency alternatives. These businesses specifically point to the 2023 emergence of synthetic derivatives like 7-OH as the primary catalyst for regulatory alarm. In response, the American Kratom Association is lobbying for state-level consumer protection legislation. These proposed acts aim to outlaw synthetic derivatives while carving out a legal space for the continued sale of traditional, unprocessed kratom.
